Implementation of Electronic Signatures in Official Document Management: An Analysis of Legal Certainty and Legal Effectiveness at UIN K.H. Abdurrahman Wahid Pekalongan
Main Article Content
Abstract
This study aims to analyze the legal certainty and implementation effectiveness of electronic signatures (TTE) within the electronic official document management system at UIN K.H. Abdurrahman Wahid Pekalongan, as well as to identify the factors influencing their application. This study employs a legal research method using an empirical juridical approach. Data were collected through literature review, interviews, and observations, and subsequently analyzed qualitatively using legal effectiveness theory and policy implementation theory. The findings indicate that the implementation of electronic signatures is currently underway, supported by consistent leadership and adequate electronic signature applications. However, its effectiveness remains sub-optimal due to the lack of comprehensive internal regulations governing usage procedures, validity assurance, and troubleshooting mechanisms for electronic signatures. Furthermore, staff understanding and dissemination still need improvement, the electronic certificate renewal process requires multi-tiered coordination with the Ministry of Religious Affairs and the Electronic Certification Center (BSrE), and incoming mail disposition is still carried out manually. Based on these findings, it is necessary to strengthen internal regulations, enhance human resource competencies, plan electronic certificate renewals, and establish standardized mechanisms for handling technical issues. Consequently, the effectiveness of electronic signature implementation relies not only on technological availability, but also on regulatory certainty, human resource readiness, and integrated institutional governance support.
